The Bathla administration now runs to 2027, and what that means if you are owed money

A court has given the administrators up to another year. Funding has been replaced, the creditor figures have moved, and lenders are taking sites over one by one.

Updated 25 October 2026. The court extension described here still stands. The funding position does not: on 24 September the emergency money was exhausted, lender discussions concluded and all construction ceased. Read what the shutdown means if you are owed money.

Stop waiting for this one to resolve

On 19 September the NSW Supreme Court extended the convening period in the Bathla administration to 13 September 2027. In plain terms, the administrators have up to another year before they are required to hold the second creditors' meeting, the one where the company's future is actually decided. ABC, 19 September 2026.

If you have been holding off on decisions about your own business until you see how Bathla lands, that is your answer. Not this month, and probably not this year.

That is not a reason to panic and it is not a deadline for you. It is a reason to plan on the basis that this money is not coming back soon, and to get on with the things that are still in your control.

The funding was replaced, not renewed

The two-week package agreed on 7 September, $3 to $5 million from five lenders, has been overtaken. Teneo now reports $4.7 million in initial funding with six lenders participating, and says talks are continuing with other financiers about longer term support. Source B6.

Construction, sales and settlements have stopped. Around 67 employees remain to support the administration, down from roughly 350 when this started. ABC, 12 September 2026.

The books do not currently add up

This is the detail that should shape your expectations more than any headline figure.

The administrators report that company bank accounts had not been reconciled for some time, and may contain about $736 million of overstated inter-company receivables and payables. Source B6.

Working that through is a large part of why they asked for a year. It also means every creditor number you have seen, including the ones below, is provisional. The reported claims now stand at $3.08 billion to secured lenders, $145 million to the ATO, $48 million to private lenders and about $110 million to other unsecured creditors, which is the line most subcontractors sit on. Around 600 subcontractors were involved in Bathla projects. Source B6, Source B7.

A receiver on your old site does not pay your old invoice

Lenders are pulling the group apart project by project. Only about five of roughly 40 lenders were funding the group's continued operation, and others have taken control of the projects securing their own loans. 360 Capital Mortgage REIT is pursuing $31.7 million across four Bathla-linked loans with receivers appointed over three of them, and Ray White Capital, Bob Ell's Leda, Balmain and Woodbridge Capital have taken control of individual projects. Source B7.

Here is where subcontractors get caught. If a receiver takes over the site you worked on and puts a new builder on it, that is not your customer coming good. ABC reports that a subcontractor owed money for work already completed may still have to pursue that debt through the administration even where a receiver has taken control. Source B7.

Work restarting on a site you were once on is not evidence that your invoice is being paid. If someone asks you back, that is a new arrangement with a new party and it needs its own written payment terms before anyone picks up a tool.

What is actually worth doing this week

  • Find out which lender is behind the site you worked on, and whether a receiver has been appointed over it. The answer can differ between two Bathla sites.
  • If you are asked to do new work, get the contracting entity, the authority to commit it, and the payment terms in writing first. If that cannot be put in writing, treat it as a no.
  • Make sure your proof of debt is lodged through Teneo's portal for the exact company named on your contract, not the group name. Teneo portal.
  • Put $0 against anything Bathla owes you and work out how many weeks your business runs on income you are confident of. On a timetable that now stretches to 2027, that number matters more than the claim does.

Where to check

Use the administrators' own notices for anything formal. Our Bathla Group administration page records what has been verified and when, with every source listed. If the unpaid account is putting pressure on your own business, the business pressure guide covers where your claim ranks and which company debts can become personal.

This page describes reported developments, not administrator instructions. Formal notices take precedence. The figures above are subject to the reconciliation described.
