When should I look beyond the creditor claim?

If a missing customer payment is making it difficult to meet your own commitments, consider qualified advice about your business as well as the claim. Difficulty paying a bill does not, by itself, establish insolvency. This page does not assess whether you can continue trading.

What should I take stock of?

Prepare a practical snapshot for yourself and your adviser:

  • Cash available now, with restricted funds identified separately.
  • Expected customer receipts, distinguishing confirmed payments from uncertain ones.
  • Supplier, payroll, super, tax and finance commitments due over the next four to eight weeks.
  • The unpaid account, how much is disputed and when you had expected payment.
  • Current finance arrangements and any notices with a response date.

Treat an uncertain creditor distribution as uncertain. Keep your own records up to date as the position changes.

What should I discuss with an adviser?

Explain which payments are becoming difficult and any deadlines you face. Ask what information they need to assess your options, their role, fees and whether specialist legal, tax or restructuring advice is appropriate.
